Frequently Asked Questions

Straight Answers About Selling Your Land to Rush Mountain Land

About Our Offer

Why is your offer lower than what I think my land is worth?

Our offer is a cash, as-is price. We pay every closing cost, take on the property as it is, and carry the time and expense of reselling it. If you listed with an agent you might get more, but you’d pay commissions and costs and could wait months or longer for a buyer. Our offer is a guaranteed, no-cost sale. If it doesn’t fit, there’s no obligation.

Can I make a counteroffer?

Yes. Write the price you’d accept on the counteroffer line of the agreement and send it back, or call us. We review every counteroffer and will get back to you within a few days.

How long is my offer good for?

Until the expiration date printed on your letter. After that, contact us and we’ll let you know if we’re still interested.

Is This Legitimate

How did you get my information?

Property ownership and tax records are public in every Arkansas county. We review those records and send offers to owners of vacant land.
Is this a scam?

It’s a fair question to ask. You never pay us anything, ever. We pay you, and only after your deed is recorded with the county, or through a title company if you’d like a neutral third party to handle the money. You can verify your offer by entering the reference number from your letter on our Contact Us page, or by calling us at (870) 955-5616.
Is this from the county or the state?

No. We’re a private company, Rush Mountain Land LLC. This is a purchase offer, not a tax bill or a government notice.

The Process

How does it work, and how long does it take?

Sign and return the agreement. We review the title and the property, usually in 1–3 weeks. Then we mail you a deed to sign in front of any notary. Once the deed records with the county, we pay you within 5 business days. From start to finish it usually takes 3–6 weeks.
Do I need to visit the property or meet anyone?

No. Everything is handled by mail and phone. Most banks will notarize your signature for free.
Can we close through a title company instead?

Yes. If you’d prefer a title company to handle the deed and the money, just tell us.

Ownership Questions

My spouse isn’t on the deed. Do they need to sign?

In Arkansas, usually yes. A spouse may have legal rights in the property even when they aren’t named on the deed, so we ask spouses to sign the deed as well. We’ll walk you through it.
I owe back taxes. Is that a problem?

No. Any back taxes are paid at closing from the sale price. You won’t need to pay anything out of pocket.
The owner on the letter has passed away. Can the family still sell?

Please call us before signing anything. It depends on how title is held and whether an estate has been settled. We’ll tell you honestly whether we can help.
What about mineral rights?

Our offer includes any mineral rights you own with the land, unless we agree otherwise in writing. If you’ve leased or sold minerals separately, let us know and we’ll review it.

Other

Please stop sending me letters.

No problem. Email brian@rushmountainland.com or call (870) 955-5616 and we’ll remove you right away.
Will this affect my taxes?

You may receive a Form 1099-S reporting the sale, as with any real estate sale. We can’t give tax advice, so please check with your tax preparer.
